Dear customer,
we would like to inform you, that the following general conditions of sale apply to all online-purchases on the website: www.prinoth.com . Prinoth GmbH based in 6410 Telfs (Austria) is considered as the seller, hereinafter referred to as “PRINOTH” and every individual or legal person, hereinafter referred to as „BUYER““, who places an online-order on the website: www.prinoth.com . The BUYER will be identified with the information on the order form sent for the sale. The sending of this order form will establish the entire acceptance of the following terms of sale.

1.) Legal basis
1.1. The European and the National laws in force foresee that the relationship between the company Prinoth and the Purchaser will be ruled by the norms for the protection of the consumers only when the buyer purchases for personal aims and not for professional aims.
1.2 if the BUYER is acting within the limits of his operating task under specification of his VAT number, the regulations between traders apply, according to the Austrian “Unternehmensgesetzbuch” UGB of 10th May,1897 idgF.

2.) Purpose
2.1. Through a virtual shop online, PRINOTH gives the possibility to vision and to buy many different promotional items.

3.) Conditions of sale
In case of incomplete or wrong information on the order form, PRINOTH is reserving the right to not deliver the ordered items.

4.) Prices
4.1. All prices include sales tax. We will charge EUR 6,00 for delivery to Italy and Austria and EUR 10,00 for the rest of the World (not Switzerland). Delivery to Switzerland will be charged CHF 15,00; Prinoth has no control over any import duties and taxes, which are to be borne exclusively by the buyer. For members of the PRINOTH Club there is no delivery charge.

5.) Execution of order
5.1. The order, sent to PRINOTH by the customer, will not be mandatory for PRINOTH itself, until PRINOTH receives payment for the ordered items.
5.2. The order will be executed in one delivery if possible. If due to technical or logistic reasons a partial delivery is required, additional fees will be on PRINOTH charge.

6.) Delivery
6.1. The time of delivery depends on the destination place, in any case the ordered items will be delivered as quickly as possible. For initial orders the time of delivery may take up to 2 weeks.

7.) Payment
7.1. Payment is possible via credit card or bank transfer. In any case, the ordered goods have to be fully paid before delivery.
7.2. Payments via credit card may be processed using VISA or MASTER CARD issued cards. The transactions will be secured through Verified by Visa and Master Card Secure Code technology.

8.) Right to return
8.1. The right to return is only valid for end customers, according to the Consumer Protection Law. The right to return is not valid for contracts between traders.
8.2. The BUYER has to withdraw from the contract within 14 days after receipt the ordered items.
8.3. The BUYER has to send a registered letter to PRINOTH within 14 days after receipt of the ordered items. This notification can also be send per fax or email within the same period of time.
8.4. This notification must include the following information:
8.4.1. The details of the order, which the BUYER wants to cancel.
8.4.2. The explicit will of the BUYER to recede the sale contract.
8.4.3. The complete bank details of the BUYER.
8.5. The ordered items have to be returned to PRINOTH within 14 days after receipt.
8.6. Charges and transportation risk for returning the items are solely at the expense of the BUYER. The restitution can be accepted only if the packaging is not internally or externally damaged. If the items show any traces of use or damage, PRINOTH is reserving the right to claim for compensation.
8.7. The amount of the returned items will be reimbursed within 30 days.

9.) Privacy
9.1. Regarding the handling of personal data, we inform you that the personal data gathered during the sale procedure on the web site www.prinoth.com will be gathered on a data base, which can be used by Prinoth and its partner companies.
The personal data will be used for aims connected to the development of the contract, for commercial and statistical aims, moreover to meet laws and fiscal obligations.
The given data will not be passed on or communicated to other persons or companies, if not in compliance to the obligations of the law, the regulations, the European norms, or to the authority instructions valid as law.

10.) Applicable law and place of jurisdiction
10.1 Any dispute arising shall be resolved under the jurisdiction of the court of Innsbruck and Austrian law shall be applied by placing an order on www.prinoth.com, the BUYER declares to have read this document as well as checked all the conditions, and is therefore accepting the general conditions of sale without any restriction.
